Course: Digital Tools for Alternative Dispute Resolution (ADR)
This practical, hands-on course is designed for mediators who wish to master the effective and responsible integration of digital tools into their Alternative Dispute Resolution (ADR) practice. Moving beyond basic software functionality, the program focuses on the strategic application of technology across all phases of mediation—from preparation and client engagement to documentation and reflection.
Drawing on real-world use cases and experiences, the course will equip participants with the technical skills and critical understanding necessary to navigate the digital landscape of mediation with confidence. We will address common barriers, such as client digital literacy and distrust, and provide a framework for building trust in digital technologies.
OECD’s new AI Literacy Framework suggests four main areas of dealing with artificial intelligence: engaging with, creating with, managing of, and designing of AI. Each category has assigned knowledge, skill and attitude components, creating a complex structure of how to handle AI. Understandably, these four domains interrelate, e.g., designing AI requires engaging and results in creation; managing AI requires some level of understanding and shaping of AI’s behaviour (“designing AI”), and can result in a higher level of engagement, etc. These types of pursuits all have their implications on the three modalities of competences: more knowledge can lead to a more positive (or well a more negative) attitude towards the emerging technologies, or the increasing skill level can lead to more motivation to gain knowledge – or even more openness (as attitude).
Deriving from the above, and narrowing down the AI competencies to a genuinely professional level, the key areas of focus include:
Strategic Tool Application: Learning how to effectively use digital tools within specific mediation phases (preparation, client work, post-mediation).
Digital Tool Catalogue: A practical overview of essential ADR tools (e.g., Zoom, Teams, Google Meet, Padlet, ChatGPT, Calendly), including their benefits, data storage considerations, and security implications.
AI Integration & Safety: Understanding and safely leveraging AI tools for tasks like email generation, document analysis, solution suggestion, and even role-play simulations.
Cybersecurity & Data Protection: In-depth coverage of crucial topics such as protecting against attacks, safe backup methods, online client identity verification, handling remotely signed documents, and ensuring confidentiality and data protection for sensitive information.
Managing Online Dynamics: Techniques for addressing the absence of non-verbal communication, setting clear rules for remote meetings (e.g., ensuring privacy and checking for third parties), and understanding the indications and contraindications for remote mediation.
Practical Workflow Tools: Exploration of tools for visualization, case management, scheduling, transcription, and creating engaging presentations.
The course incorporates a blended learning approach, combining interactive webinars with asynchronous micro-lessons, short texts, presentations, videos, and quizzes, ensuring flexible and comprehensive skill development.
